Man claims marriage illegal, but loses maintenance battle | India News


MUMBAI: The appearance of a 45-year-old city woman’s name in her husband’s ration card and his name on her Aadhaar Card has ensured that she secured maintenance even as her spouse claimed that their marriage was illegal as she had not divorced her first husband.
Observing that a domestic relationship existed between the two under the Domestic Violence Act, a sessions court upheld a lower court order, directing the 61-year-old jalebi seller to pay Rs 11,000 per month and Rs 20,000 compensation to his estranged wife, a tailor.
“…the trial court has rightly considered the prima facie fact that the name of the applicant wife was entered in the Ration Card of the respondent’s family and his name was also appearing as her husband on her Aadhaar Card. The parties resided under one roof for a period of 14 years after she took customary divorce from her first husband. Admittedly, she had never suppressed the fact of her first marriage from the respondent,” the court said.
